Terms and Conditions – Fastwingoods (English Version)

1. Scope

These Terms and Conditions (AGB) apply to all orders and contracts concluded via the www.piotrend.shop online store (operated by Fastwingoods) with customers in Switzerland and Liechtenstein. Any terms and conditions of the customer that deviate from or conflict with these AGB will not be recognized unless Fastwingoods expressly agrees to their application. By placing an order with Fastwingoods, the customer accepts these Terms and Conditions.

2. Conclusion of Contract

The product listings on piotrend.shop do not constitute a binding offer but rather an invitation to customers to submit a purchase offer. By completing the checkout process, the customer submits a binding offer to purchase the selected products. Fastwingoods will then acknowledge receipt of the order via an automated email (order confirmation). This order confirmation does not yet signify acceptance of the offer, but merely informs the customer that the order was received.

A binding purchase contract is only formed when Fastwingoods expressly accepts the customer’s order. Acceptance is declared either by an explicit order confirmation, by sending a shipping confirmation (including tracking information), or at the latest by dispatching/delivering the goods to the customer. The contract only covers those items explicitly listed in the shipping or order confirmation; there is no contract for any items not mentioned therein. If any ordered products are not available, Fastwingoods will inform the customer promptly. Claims for damages due to delayed or undeliverable items are excluded, and in such cases Fastwingoods reserves the right to withdraw from the contract.

Orders will only be accepted from persons with legal capacity to contract. Customers under the age of 18 confirm that they have the consent of their legal guardian by placing an order. Fastwingoods reserves the right to refuse orders on a case-by-case basis or to only execute them against advance payment (especially in cases of negative credit checks or outstanding payments from the customer).

3. Prices and Payment Terms

All prices on piotrend.shop are listed in Swiss Francs (CHF) and include the statutory VAT. Any additional charges (such as shipping costs) will be displayed during the checkout process. Fastwingoods strives to ensure current and correct pricing; however, price errors remain reserved. In the event of obvious pricing or typographical errors, Fastwingoods reserves the right to correct them and, if necessary, to withdraw from contracts where the error was evident to both parties.

Payment Methods: We offer the following payment options:

  • Credit Card (Visa, MasterCard, etc., processed via our payment provider Stripe)
  • TWINT (Swiss mobile payment app)
  • PayPal (online payment service)
  • Purchase on Invoice (invoice payable within 20 days from invoice date)

For invoice payments, the invoiced amount is due within 20 days of the invoice date. Invoices may be sent electronically via email or enclosed with the shipment. If payment is not received within 20 days, the customer will be in default without further reminder. In case of payment default, Fastwingoods is entitled to charge default interest at the statutory rate (5% p.a.) and to bill the customer for reminder fees and any collection costs. Fastwingoods may assign outstanding debts to a debt collection agency if the customer fails to pay despite reminders, and the customer will bear any resulting costs.

Fastwingoods reserves the right to conduct a creditworthiness check before concluding the contract. If the payment method purchase on invoice is offered, Fastwingoods may refuse this method or require prepayment in the event of insufficient creditworthiness. Retention of title: The delivered goods remain the property of Fastwingoods until full payment has been received (see Section 7 below).

4. Delivery

Delivery Area: We ship to addresses in Switzerland and Liechtenstein only. Delivery is generally carried out by established shipping service providers such as DHL, UPS, or Swiss Post. Fastwingoods reserves the right to use additional appropriate carriers in individual cases.

Delivery Time: The standard delivery time is 2–4 working days from the dispatch confirmation, unless otherwise stated for the product. If delivery within this timeframe is not possible, Fastwingoods will inform the customer in a timely manner. Partial deliveries are permissible, provided they are reasonable for the customer. If an order is shipped in multiple parts, shipping costs will be charged only once.

Shipping Costs: Fastwingoods may charge a shipping fee to cover packaging and postage. The exact shipping costs are calculated and displayed to the customer during checkout. Fastwingoods may waive shipping charges for orders above a certain value (according to the information provided in the online shop).

Transfer of Risk: For sales to consumers, the risk of accidental loss or damage to the goods passes to the customer upon handover of the goods to the customer. If the customer provides an incorrect or incomplete delivery address resulting in additional costs (e.g. rerouting or return fees), the customer may be charged for those costs.

Fastwingoods is not liable for delivery delays caused by force majeure, transport disruptions, extraordinary events, or due to the fault of third parties outside of Fastwingoods’ control. Claims for compensation due to delayed delivery are – to the extent permitted by law – excluded.

5. Right of Return (14 Days)

Fastwingoods grants private customers a voluntary 14-day right of return for goods purchased, starting from the day the customer receives the goods. Within this 14-day period, the customer may return the products without having to state a reason. The return period begins on the day after the goods have been delivered to the customer. It is sufficient if the customer dispatches the return or notifies Fastwingoods of the intention to return within the 14-day period.

Conditions for returns:

  • The product must be unused, unworn, and undamaged. Trying on apparel for fit is allowed, as long as it does not leave any traces of use.
  • The product must be returned in its original packaging, including all accessories, tags, and manuals as applicable.
  • A copy of the invoice or delivery note should be included with the return to facilitate processing. We recommend contacting our customer service before returning an item to obtain a return authorization or shipping label if available.

Exclusions: For hygiene reasons, underwear and similar hygienic items are excluded from return once their seal or original packaging has been opened. Likewise, custom-made or personalized items, as well as sealed goods that are unsuitable for return due to health protection or hygiene reasons (once unsealed), are not eligible for return.

Return Shipping Costs: The cost of returning goods is borne by the customer, unless the delivered item was defective or not as ordered. In the case of wrong or faulty delivery attributable to Fastwingoods, we will cover the return shipping cost and provide a replacement or a refund of the purchase price.

Fastwingoods will inspect all returned items upon receipt. If returned products show signs of use or are not in their original new condition, Fastwingoods reserves the right to refuse the return. In such case, the item may be sent back to the customer at the customer’s expense with no refund. Otherwise, if the return is made in accordance with the above conditions and within the 14-day period, Fastwingoods will refund the purchase price of the goods via the original payment method within 14 days of receiving the returned goods. Any original shipping fees paid by the customer will be refunded only if the return is due to an error by Fastwingoods.

This voluntary return policy does not affect any statutory rights of the customer (in particular, warranty rights for defects).

6. Warranty and Guarantee

Statutory Warranty: Fastwingoods is liable for material or manufacturing defects in delivered products in accordance with the provisions of Swiss law (Swiss Code of Obligations on warranties for sales contracts). The statutory warranty period is – unless otherwise provided below – 24 months from the date of delivery of the goods to the customer. The customer is advised to inspect the goods as soon as possible upon delivery and to notify Fastwingoods promptly of any defects. Any apparent defects should be reported immediately, and hidden defects must be reported as soon as they are discovered. If the customer fails to report a defect in a timely manner, the goods are deemed accepted in their condition.

Guarantee Periods by Product Category: Notwithstanding the statutory warranty (and to the extent permissible by law), Fastwingoods provides the following limited guarantees for certain product categories:

  • Electronic devices: 24-month guarantee from the date of delivery. If an electronic item exhibits technical defects within this period, Fastwingoods will, at its discretion, repair the item, provide a replacement, or issue a refund/credit for the item. The invoice serves as the warranty certificate, so please retain it for the guarantee period.
  • Clothing and shoes: 14-day limited guarantee from the date of delivery, provided that the items have only been tried on for fitting and remain in like-new condition. Any defects (e.g. manufacturing faults such as open seams or incorrect sizing labels) must be reported within this 14-day period. After 14 days, claims for defects in clothing and footwear are excluded if the issue was not timely reported or unless otherwise required by law. Returns of garments that have been worn (beyond trying on) or washed are not accepted.
  • Underwear and hygiene items: Apart from the above-mentioned exclusion from the return policy, no warranty or guarantee applies to opened underwear or similar hygienic products, except for initial material defects. If a sealed underwear item is found to be damaged or defective upon delivery, the customer should report the defect immediately. Fastwingoods will then provide an appropriate remedy (replacement or refund) in such cases.
  • Other products (e.g. jewelry, accessories): For all other items not explicitly mentioned above, the statutory warranty period of 24 months from delivery applies, unless a longer period is mandated by law.

Procedure for Defects: In the event of a warranty or guarantee claim, the customer must contact Fastwingoods (for example, via email with a description of the issue and the order/invoice number). Fastwingoods may, at its discretion, require the customer to return the defective product for inspection or to provide photographic evidence of the defect. Valid warranty claims will be addressed at no cost to the customer, and Fastwingoods will decide whether to remedy the defect (repair), send a replacement product, or refund the purchase price.

Exclusions: The warranty and guarantees do not cover damages that are not due to manufacturing or material defects. In particular, no warranty is given for normal wear and tear, or for damage resulting from improper use, handling, or storage by the customer. Warranty claims are especially void if a defect is caused by modifications, repairs, or attempts to repair by the customer or unauthorized third parties, or by failure to follow the product’s operating or care instructions. Likewise, defects arising from failure to follow washing or care instructions for textiles are not covered.

Any further claims by the customer – in particular claims for damages such as compensation for consequential damages, lost profits, or other indirect losses – are limited or excluded in accordance with Section 8. Liability below.

7. Retention of Title

Fastwingoods retains ownership of all goods supplied to the customer until full payment of the purchase price and any related charges has been received. Until such payment is made in full, the goods remain the property of Fastwingoods. The customer shall handle goods under retention of title with care and may not sell, pledge, or otherwise dispose of them before ownership has passed. In the event of payment default, Fastwingoods has the right to demand the return of goods subject to retention of title and to withdraw from the contract if necessary.

8. Liability

Fastwingoods shall be liable without limitation for damages arising from injury to life, limb, or health that are caused by an intentional or grossly negligent breach of duty by Fastwingoods or its legal representatives or vicarious agents. For all other damages, regardless of the legal basis, Fastwingoods is liable only for intent and gross negligence. In cases of slight negligence, Fastwingoods shall only be liable for breach of essential contractual obligations (cardinal duties), and such liability is limited to the typical and foreseeable damages at the time of contract conclusion. Any further liability is excluded to the extent permitted by law. These limitations of liability also apply to non-contractual claims.

Liability under the Swiss Product Liability Act is not limited or excluded by the foregoing provisions. Likewise, any mandatory statutory liabilities (e.g. as per the Swiss Code of Obligations) remain unaffected. Fastwingoods is not liable for any damage resulting from improper use of the products or from information provided by the customer (such as incorrect measurements for custom orders).

No liability for data errors: Fastwingoods strives to provide accurate product descriptions, availability information, and pricing on the website. However, printing, typographical or data processing errors may occur. Fastwingoods assumes no liability for obvious errors or inadvertent mistakes on the website, particularly with respect to clearly incorrect price labels or product details. Fastwingoods reserves the right to correct such errors and to cancel orders if a mistake in the terms of the offer was apparent to both parties. Claims for damages based on such errors are excluded.

9. Data Protection

Protecting our customers’ personal data is very important to Fastwingoods. We collect, process, and use personal data in strict compliance with applicable data protection laws and in accordance with our separate Privacy Policy. All customer data is treated confidentially and will not be disclosed to third parties without the customer’s consent, except as necessary to fulfill the contract or as required by law. Details on the scope, purpose, and use of personal data collected can be found in our Privacy Policy available on our website. The Privacy Policy is not part of these Terms and Conditions but is provided separately for the customer’s information.

By using the online shop and placing an order, the customer consents to the processing of their personal data as described in the Privacy Policy. Fastwingoods is not liable for the security of data during transmission via the internet (for example, in the event of technical problems beyond our control).

10. Jurisdiction and Applicable Law

All legal relations between Fastwingoods and the customer shall be governed by Swiss law, to the exclusion of its conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is 5430 Wettingen, Switzerland. However, Fastwingoods reserves the right to initiate legal proceedings against the consumer at the courts of the customer’s domicile, insofar as no mandatory statutory provisions specify otherwise.

For consumers residing in Liechtenstein, any mandatory consumer protection provisions of Liechtenstein that apply pursuant to Article 120 of the Swiss Federal Act on Private International Law (IPRG) or relevant international treaties remain unaffected, insofar as they would apply. This does not affect the above choice of Swiss law as the governing law or the agreement on jurisdiction.

11. Final Provisions

Changes to the Terms: Fastwingoods reserves the right to amend these Terms and Conditions at any time with future effect. Any changes will not apply to contracts that have already been concluded prior to the change. The version of the Terms and Conditions in effect at the time of the order shall govern that order, as made available on piotrend.shop at that time.

Severability: Should any provision of these Terms and Conditions be or become invalid, unenforceable, or void, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be deemed replaced by a valid and enforceable provision that comes closest to the economic intent of the original provision. The same applies in the event of any contractual omissions.

Contract Language: These Terms and Conditions are originally written in German and have been faithfully translated into English. In the event of any ambiguity or conflict between the German text and the English translation, the German version shall prevail as the legally binding text.
